Even though the law changed Oct. 1st as regards durable powers of attorney, if you have a valid, reasonably current POA prepared by a FL estate planning attorney, you are probably 'good to go' for a little while at least. However, be sure that when you next meet with your estate planning attorney for your periodic review, that you update and sign a new POA at that time so you and your loved ones remain protected.

Rule #3: With IRA's, subject to state law, you can generally name whomever you want as the beneficiary, without your spouse's consent. Choosing your health care surrogate is an important decision because that person will speak for you to ensure your wishes are carried out when you are unable to speak for yourself. You want to be sure that your heath care surrogate is easily accessible by your medical team and is a person you can count on to honor and communicate your personal wishes (and is someone who will be "strong" emotionally in the face of great stress). Your health care surrogate doesn't have to be a close family member but could also be a trusted friend or neighbor. If you do choose a non-family member as your health care surrogate, you should explain your choice to your family to help avoid conflict or misunderstanding later.

What's the difference between a 1st party and 3rd party Special Needs Trust (SNT)? A 1st party SNT is funded with assets of the disabled person (maybe an inheritance, personal injury award, etc.). A 3rd party SNT is funded with assets donated by another party, usually a family member (grandparent, aunt/uncle, parent, etc.). When properly drafted, neither SNT will jeopardize public assistance benefits. However, upon death, the assets of a 1st party SNT must be used to reimburse Medicaid for benefits received during the disabled person's life.

A lot of folks ask me to quote them a fee for their estate planning before they make an appointment. Unfortunately, it is very difficult for me to quote even fee ranges without having first sat down down with the folks to look at their situation and see what it is they are trying to accomplish with their planning. A lot depends on where folks are starting from too in terms of titling of assets, beneficiary designations, values, family dynamics, etc. Sometime I have clients come in and we don't need to do a thing. Other times, clients think they have a "simple" case and it turns out to be not quite so simple.

That's why instead I offer clients a free initial consultation. At that consult, I can quote a flat fee or option of flat fees for the planning they want to accomplish, which again I won't know until we sit down and chat. If they want to move forward, then we can design their family's estate plan right then and there. Or they can go home and think about it. Either way, I promise folks they will leave more educated about where they stand and where their current "exposure" is. Also, some things they can change on their own to make sure their family is protected.

So.... the first step in getting your family's estate plan in order is to schedule your free initial consultation.
